The Patent and Market Court rejects Verisk Analytics’ request for a stay of the Swedish Competition Authority’s decision on abuse of dominant position. As a result, the company must immediately cease exclusive clauses that have prevented insurance medical consultants from working for competitors, even though the appeal continues. The decision includes a competition damage fine of SEK 14.3 million and a conditional fine of SEK 30 million.The investigation began after a complaint from Opsy in January 2023. "The court’s decision is welcome. The exclusive clauses have for several years limited the insurance medical consultants’ ability to work broadly and have thereby held back competition in the industry. That the injunction continues to apply means that the consultants already now get real freedom of choice and that more players get the opportunity to compete on equal terms," says Arne Thor, CEO of Opsy.
